More info from the US Bankruptcy Court can be found here in a document initially published by USCOURTS.GOV. David has repeatedly filed, but has been unable to successfully "go bankrupt." Many people have sued David and won, but have been unable to collect any money. According to this court document, Mr. Waathiq owes the Internal Revenue Service at least $35,000.00 Here is the relative passage:

5. The IRS filed a secured claim in the amount of $33,411.37 for unpaid withholding taxes from 1991, and a priority claim of $1,682.33 for unpaid income taxes from 1997 and 1998. It appears that the claim for withholding taxes is unsecured because there is probably no unencumbered collateral to which it can attach. It is also likely, however, that the claim is entitled to priority under 11 U.S.C. § 507(a)(8). To the extent allowed, the claim for unpaid income tax would be entitled to priority under § 507(a)(8). So if you sue and win against Mr. Waathiq you'll be in line behind the IRS and according to one of David's former and unpaid web designers many, many others.
